Who are the parties in this agreement? Who is the offeror and who is the offeree?
What is the offer on the table? What does the offeror offer to do for the offeree?
What does the offeree need to do or give in exchange? (Consideration)
Do both parties have the capacity to enter this agreement? Why or why not?
How did the parties agree? Was it in writing, orally or with a handshake? Was it implied?
Were there any instances of misrepresentation, fraud, undue influence or duress?
Were both parties able to perform as promised? Why or why not? Was there a breach of contract?
Feel free to use other terms and concepts from this lesson to describe the contract/agreement.
